1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of PromptPlum, including our website at promptplum.com and our mobile app for iOS and Android, together the "Service." By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

2. Description of the Service

PromptPlum is a library of AI photo-editing text prompts. You can browse, search, and copy prompts without creating an account. Optional account features let you save and like prompts. The Service does not generate images itself; you use the prompts with third-party AI tools of your choice. The Service is provided free of charge — there are currently no payments, subscriptions, or paid features.

3. Accounts

• Eligibility: You must be at least 13 years old (or the minimum age required in your jurisdiction) to create an account and use account features.
• Account creation: You may create an account using an email address and password, Google Sign-In, or Sign in with Apple.
• One account: You agree to maintain only one account and to provide accurate information.
• Responsibility for credentials: You are responsible for safeguarding your login credentials and for all activity under your account. Notify us promptly if you suspect any unauthorized use.

4. Acceptable Use and Prohibited Conduct

You agree to use the Service lawfully and responsibly. You must not:

• Upload, distribute, or transmit malicious code, malware, viruses, or any harmful content;
• Send spam or engage in unsolicited or abusive communications through the Service;
• Scrape, crawl, harvest, data-mine, or use automated means to extract content or data from the Service without our prior written permission;
• Attempt to gain unauthorized access to the Service, other users' accounts, or our systems, or otherwise interfere with or disrupt the Service;
• Use the Service to infringe the intellectual property or other rights of any third party, or for any unlawful, harmful, or fraudulent purpose;
• Misrepresent your identity or impersonate any person or entity.

We may remove content and suspend or terminate access for conduct that violates these Terms.

5. Intellectual Property

• Prompts: Prompts on the Service are provided for educational and creative use. When you use prompts with third-party AI tools, you are responsible for complying with the licenses, terms, and AI-art and copyright rules that apply in your jurisdiction and to the tools you use.
• PromptPlum's content and branding: The Service, including its design, organization, text, logos, name, and other branding, is owned by PromptPlum or its licensors and is protected by intellectual property laws. Except for the permitted use of prompts described above, you may not copy, reproduce, distribute, or create derivative works from the Service without our prior written permission.

6. Third-Party AI Tools Disclaimer

The Service provides text prompts intended for use with third-party AI image and photo-editing tools. We do not operate or control those tools. AI-generated results are non-deterministic and may vary, and may not match any example or expectation. We are not responsiblefor the third-party AI tools you choose to use, their output, their availability, or their terms of service. Your use of any third-party tool is solely between you and that tool's provider.

7. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any content or prompt will produce a particular result.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PROMPTPLUM AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF (OR INABILITY TO USE) THE SERVICE OR ANY THIRD-PARTY AI TOOLS, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

9. Termination

• By us: We may suspend or terminate your access to the Service, or your account, at any time, with or without notice, if we believe you have violated these Terms or to protect the Service or other users.
• By you: You may stop using the Service at any time. You may permanently delete your account and its associated data at any time in the app via Settings → Delete account, or by contacting us.

Provisions that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) will survive.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of India, without regard to its conflict-of-laws principles. You agree that any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts located in India.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last Updated" date above. Material changes will be communicated through the Service where appropriate. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
